Flint Arrow LLC was hired to build a single family residence in a good and workmanlike manner according to the terms of the Contract. Instead of delivering a completed home, David Rothenberg has left us with a defective half finished home after nearly two years.
The only thing worse than the poor workmanship and broken promises is the fact that David Rothenberg drew hundreds of thousands of dollars from our loan that he wasn't entitled to. In addition to breaching many important provisions of the construction contract, he refused to follow our specifications. He also refused to provide Disbursement Statements during the first one and a half years. This is a violation of Texas Law. The result was unpaid subcontractors, lien filings by his subcontractors, and many thousands of dollars of missing items that we paid for.
David referred us to his personal bank that provided the construction loan. Texas law requires that the Contractor provide the Owner with a disbursement statement at each draw. Flint Arrow submitted draw requests directly to the bank, refused to give us copies, keeping us completely in the dark about what he was drawing money for.
Our Contract specified that Contractor would invoice Owner for expenses incurred. Despite this fact, Flint Arrow LLC would draw hundreds of thousands more money from the bank than expenses incurred.
Because Flint Arrow didn't provide Draw Requests or Disbursement Statements the us for 1.5 years, we didn't know that David Rothenberg drew over $200,000 more than expenses incurred. After we received the first subcontractor lien on our home for unpaid work, we asked Rothenberg all the Disbursement Statements he was legally required to provide under the Texas Property Code. His response was “I will leave that portion between you and the bank”. David Rothenberg has now gone silent and is nonresponsive to our communication.
To make matters worse, David Rothenberg drew the money from our loan for major items and then didn’t pay for those items. Now there is not enough money remaining on the loan to pay for those items. There are currently mechanic's liens on the home and Rothenberg refused to get them removed although the Contract requires that he do so. We continue to get letters and calls from more contractors and suppliers who he failed to pay.
The quality of work that was performed by Flint Arrow could not be worse. We have not found a single part of the home that was completed in a good and workmanlike manner. David Rothenberg hired unqualified subcontractors with the apparent motivation of lowering costs and increasing his own profit. We hired a third-party inspector to inspect the home after framing. We received a 20 page report on the deficiencies. The independent report indicated that Flint Arrow didn’t even install the windows properly and failed to flash the windows. Instead of making it right, David charged us to remove all the windows, properly flash each one and then reinstall. The report also indicated the rear patio was sagging. Again, David charged us to fix his issue, but even after the attempted repair, we can still see sagging. We would ultimately discover the foundation, roof, plumbing, electrical and some walls are defective.
Flint Arrow left the house open and exposed to weather for many months. We hired a 3rd party mold inspection service who reported water damage and elevated moisture readings likely caused by rainwater and a swollen wood subfloor. Flint Arrow has not resolved these issues.
Contractor was paid to install fencing. The fence on the side wobbles terribly with the slightest push by one finger. The fence in the front started rusting after just a few weeks.
Contractor attempted to add 20% to our allowance items in the contract although not authorized to do so. David argued " We do need to get compensated for our efforts or it does not make sense for us to involve ourselves in portions of the job without compensation for Flint Arrow”.
We communicated the cabinet type was to be wood multiple times verbally and via email. Flint Arrow arrow represented they would be wood and provided an invoice stating Maple was the material. We unwrapped one cabinet to check the quality and the door immediately fell apart exposing particle board and MDF. After taking a closer look, the cabinets delivered to our home look like complete garbage.
Flint Arrow cut the electric line to our existing home on the property. Instead of repairing it, they ran a high voltage (230 Volt) cord on top of the ground without using conduit. This careless act creates a risk of electrical shock, short circuit and a fire hazard. The complete disregard for basic safety jeapordizes the lives and safety of everyone on the property. This is a gross violation of codes and the resulting hazard could electrocute anyone who may come in contact. It is especially concerning for children and pets.
While doing electrical repairs to correct David Rothenberg's defects, our new electrician discovered that the electrical wire feeding the home was severely undersized for the load. When too small of a wire is used, the wire may overheat, melt down or catch fire.
Failure to adequately prepare and paint the surface caused paint adhesion failure and rusting in just weeks. The fence is disintegrating. David Rothenberg notified multiple times 6+ months ago yet no action taken.
"We did not specify pine. MDF is a wood product."
